Acceptance of Terms
By using this website or engaging Proystudio Inc. ("Proystudio," "we," or "us") for services, you agree to these Terms of Service. If you do not agree, please do not use the website or our services.
Services
Proystudio provides BIM modeling, construction documentation, 3D visualization, and interior design services. All services are delivered per the scope agreed upon in individual project proposals.
Professional Responsibility and Licensing
Proystudio provides drafting, modeling, documentation, and visualization services. Unless expressly stated in a signed proposal, our deliverables are not sealed, stamped, or certified by a licensed architect or engineer and do not constitute licensed architectural or engineering services. Where applicable law requires drawings to be prepared, reviewed, or sealed by a licensed professional for permitting or construction, the client is responsible for engaging a qualified licensed professional to review, approve, and seal those documents. The client is solely responsible for verifying that all deliverables comply with applicable codes, regulations, and permitting requirements before they are used for construction or submitted for permits.
Project Proposals
Each engagement is governed by its individual project proposal, which defines the specific scope, deliverables, timeline, and fees. If anything in a signed proposal conflicts with these Terms, the signed proposal controls for that engagement.
Client Responsibilities
The client is responsible for providing accurate and complete information, supplying any required source materials, and giving timely feedback and approvals. Delays in providing information or approvals may affect project timelines.
Intellectual Property
Upon full payment, clients receive ownership of final deliverables. Proystudio retains the right to display completed work in its portfolio unless otherwise agreed in writing.
Payment Terms
Payment terms are outlined in each project proposal. Work commences upon receipt of the agreed deposit. Final files are released upon receipt of final payment.
Revisions, Cancellation, and Refunds
The number of included revisions is defined in each project proposal. Additional revisions may be subject to further fees. If a project is cancelled after work has begun, deposits are non-refundable, and the client will be billed for any work completed up to the cancellation date.
Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose. This does not limit any rights that cannot be waived under applicable law.
Limitation of Liability
Proystudio's liability is limited to the amount paid for the specific service in question. We are not liable for indirect or consequential damages.
Governing Law
These terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will revise the "Last updated" date above. Continued use of our website or services after changes take effect constitutes acceptance of the revised Terms.
